Welcome to Real Western Life.

These Terms and Conditions (“Terms”) govern your use of RealWesternLife.com, shop.RealWesternLife.com, our custom-order pages and forms, and other websites or online services operated by Real Western Life LLC that link to these Terms (collectively, the “Site”).

By accessing or using the Site, creating an account, submitting information, or purchasing products from us, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site.

1. Eligibility

You must be legally capable of entering into a binding agreement to make purchases through our Site.

Our Site and ecommerce services are intended for adults.

A parent, guardian, or other authorized adult may order children's products or provide child-related personalization information as described in our Privacy Policy.

2. Our Products

Real Western Life offers products that may include:

Western, wildlife, children's, faith, military and patriotic quilts; custom ranch-brand quilts; personalized and heirloom products; apparel; gifts; print-on-demand merchandise; and other products inspired by western life, heritage, family, faith, service, tradition, and related themes.

Some products are completed and ready to ship. Others may be customized, personalized, printed, embroidered, quilted, or produced after purchase.

Product availability may change without notice.

3. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, colors, prices, and other information.

However, reasonable differences can occur.

Colors displayed electronically may vary from the physical product because of lighting, photography, screens, monitors, devices, fabric dye lots, printing, and other factors.

Handmade and individually produced products may have minor variations in stitching, quilting, fabric placement, pattern placement, embroidery, dimensions, texture, or construction.

Reasonable handmade or color variations are not defects.

4. Orders

Submitting an order constitutes an offer to purchase the products identified in the order.

We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including because of:

inventory or material availability, pricing errors, suspected fraud, payment problems, inability to fulfill customization requirements, prohibited customer-supplied content, or circumstances outside our reasonable control.

An automated order confirmation does not prevent us from correcting an error or canceling an order when reasonably necessary.

If we cancel an order that has already been paid, we will refund the applicable amount unless otherwise permitted or required by law.

5. Prices and Payment

Prices are displayed in the currency indicated on the Site.

Applicable taxes, shipping charges, or other charges may be added during checkout.

Our online store currently uses Shopify and payment services available through Shopify to process transactions.

We may add, replace, or discontinue payment methods in the future.

Real Western Life does not generally receive or store your complete credit- or debit-card number.

We reserve the right to correct genuine pricing or listing errors.

6. Customer Accounts

Customers may have the option to create an account.

You are responsible for maintaining the confidentiality and security of your login credentials and for activity occurring through your account.

Please notify us if you believe your account has been accessed without authorization.

We may suspend or terminate accounts reasonably believed to be involved in fraud, abuse, unlawful activity, or violations of these Terms.

7. Custom and Personalized Orders

Customers may request products incorporating information or materials such as:

names, dates, ranch or livestock brands, photographs, logos, artwork, memorial information, military or service information, faith-related material, personalization, colors, or other customer-selected content.

You are responsible for the accuracy of information you provide.

When a design proof is provided, you are responsible for reviewing the proof carefully before approving production.

Your approval authorizes Real Western Life to produce the item substantially according to the approved proof.

Customer-provided errors or errors visible in and accepted through an approved proof ordinarily do not qualify as production defects.

8. Customer-Supplied Artwork, Brands, Photos & Other Materials

By submitting photographs, artwork, logos, ranch brands, livestock brands, text, trademarks, names, or other materials for reproduction, you represent that:

You own the material or have sufficient permission, authorization, license, or other legal right to allow Real Western Life to use it for your requested order.

You agree not to knowingly submit content that infringes another person's copyright, trademark, privacy, publicity, or other legal rights.

You grant Real Western Life and any necessary production or fulfillment provider a limited, non-exclusive right to reproduce and process the submitted material solely as reasonably necessary to design, manufacture, fulfill, and support your order.

Submission of custom material does not automatically give Real Western Life permission to use private customer materials in advertising or promotional content.

Marketing use of customer photographs, private ranch-brand designs, family information, children's information, memorial materials, or other private custom-order materials will be handled in accordance with our Privacy Policy.

We reserve the right to decline content that we reasonably believe we should not reproduce.

9. Proof Approval

When a proof is provided, customers should carefully verify:

spelling, names, dates, wording, brand configuration, photographs, artwork, layout, colors, orientation, placement, and other personalization.

Once approved, production may begin and changes may no longer be possible.

Approval of a proof constitutes authorization to proceed with the design shown.

10. Cancellations

Unless otherwise expressly stated, orders cannot be canceled after they have been submitted and accepted for processing.

Custom, personalized, made-to-order, and print-on-demand production may begin shortly after purchase.

Our complete cancellation terms are contained in our Returns, Refunds, Exchanges & Cancellations Policy, which is incorporated into these Terms by reference.

11. Returns, Refunds & Exchanges

Unless otherwise expressly stated, all sales are final.

Real Western Life does not accept returns or exchanges for buyer's remorse, change of mind, incorrect size selection, personal preference, or similar reasons.

This does not eliminate remedies that may apply to genuinely damaged, defective, materially incorrect, or misrepresented products, or rights that cannot legally be waived.

Please review our Returns, Refunds, Exchanges & Cancellations Policy before purchasing.

12. Shipping and Delivery

Shipping and delivery estimates are estimates unless we expressly guarantee otherwise.

Actual delivery may be affected by carriers, weather, holidays, customs, supply issues, production schedules, or other circumstances outside Real Western Life's reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

Specific shipping terms may also be stated in our Shipping Policy or product listing.

13. Production and Fulfillment Partners

Real Western Life may use third parties to assist with printing, embroidery, quilting, digitizing, sewing, manufacturing, packaging, fulfillment, shipping, or other services.

Examples may include Printify and other current or future providers.

Use of a production or fulfillment partner does not transfer ownership of the Real Western Life brand or customer relationship to that provider.

Information provided to these companies is handled as described in our Privacy Policy.

14. Intellectual Property

Unless otherwise stated, the Site and content created or owned by Real Western Life LLC—including our branding, text, product photography, graphics, designs, website content, marketing materials, logos, and original creative content—are owned by or licensed to Real Western Life LLC and are protected by applicable intellectual-property laws.

You may use the Site for ordinary personal, noncommercial shopping and informational purposes.

Except as allowed by law or with our written permission, you may not reproduce, copy, republish, distribute, sell, sublicense, commercially exploit, or create unauthorized derivative works from protected Real Western Life content.

This section does not claim ownership of customer-owned photographs, ranch brands, logos, artwork, or other intellectual property merely because those materials are submitted to us for a custom order.

15. Reviews, Testimonials & Customer-Submitted Content

Customers may voluntarily provide reviews, testimonials, photographs, comments, or other feedback regarding Real Western Life or its products.

When you directly provide content to Real Western Life for publication or expressly authorize us to use it for promotional purposes, you grant Real Western Life LLC a non-exclusive, royalty-free license to reproduce, display, publish, format, and use that approved content in connection with our website, social media, advertising, marketing, and promotional materials.

We may correct spelling, grammar, formatting, or length provided that we do not intentionally alter the material meaning of a testimonial.

We will not knowingly create, purchase, publish, or represent fake or false reviews as genuine customer reviews.

If a review or testimonial involves compensation, free merchandise, discounts, or another material relationship, we will make disclosures when required by applicable law.

Any incentive we may offer for submitting a review will not be conditioned upon the review being positive.

We do not prohibit customers from expressing honest opinions about Real Western Life or our products.

Private customer communications are not automatically testimonials.

We will not intentionally publish a private email, private message, private photograph, ranch brand, customer-specific artwork, or other private custom-order material as advertising merely because the customer sent it to us.

Where appropriate, we will obtain separate permission before featuring such material.

This distinction is important under current FTC rules: displaying a customer's review in your advertising can turn it into a testimonial, and businesses cannot use fake or misleading testimonials or condition incentives on favorable reviews.

16. Prohibited Uses

You may not use our Site to:

engage in unlawful or fraudulent activity; interfere with the Site's operation or security; attempt unauthorized access to systems or accounts; introduce malicious code; impersonate another person; infringe intellectual-property or privacy rights; scrape or harvest information in violation of applicable law; or use the Site in a way that materially harms Real Western Life or other users.

17. Third-Party Services and Links

Our Site may contain links to or integrations with third-party platforms such as Shopify, Facebook, Instagram, Google, Pinterest, TikTok, YouTube, payment providers, shipping carriers, and others.

Third-party services are governed by their own terms and privacy practices.

Real Western Life is not responsible for third-party websites or services that we do not control.

18. Privacy

Use of personal information is governed by our Privacy Policy.

Our Privacy Policy explains our use of Shopify, Hostinger Reach, advertising and analytics technologies, custom-order information, cookies, Shopify Network Intelligence, customer privacy rights, and related practices.

19. Email and Electronic Communications

When you provide contact information in connection with an order, we may send transactional communications reasonably necessary to process or support that order.

Marketing email is handled separately in accordance with our Privacy Policy and applicable law.

Providing an email address for an order does not automatically mean that you have subscribed to promotional email.

20. Text Messages

If Real Western Life offers promotional SMS/text messaging in the future, enrollment will be governed by the consent presented at sign-up and applicable law.

Providing a telephone number for shipping, an order, or customer service does not by itself enroll you in promotional text messaging.

21. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site is provided on an “as available” basis.

We do not guarantee that the Site will always operate without interruption or error.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Real Western Life LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the Site.

Nothing in these Terms limits liability where doing so would be prohibited by applicable law.

Product-specific remedies and consumer rights remain subject to applicable law and our published policies.

23. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your knowing submission of materials that infringe another person's rights.

This provision does not apply where prohibited by consumer-protection law.

24. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

26. No Waiver

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision later.

27. Changes to These Terms

We may update these Terms periodically as our business, products, services, technologies, or legal obligations change.

Updated Terms will be posted on the Site with a revised effective date.

Changes will apply prospectively except where otherwise permitted or required by law.
